Craftitivity Terms of Use (End User License Agreement)

These Terms of Use ("Terms") are a legal agreement between you ("you" or "User") and Craftitivity ("Craftitivity," "we," "us," or "our") governing your use of the Craftitivity mobile and web application and related services (collectively, the "App" or "Service").

By creating an account, downloading, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to create a Craftitivity account. By using the App, you represent that you meet this requirement. If you are under the age of majority in your jurisdiction, you may only use the App with the involvement of a parent or legal guardian.

2. Description of Service

Craftitivity allows users to save, organize, and revisit craft-related inspiration, videos, and personal project ideas, including content saved from third-party platforms, user-uploaded photos and journal entries, and messaging with friended users. Features and availability may vary by subscription tier (Free, Crafter, Crafter Plus) and may change over time.

3. Accounts

• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You agree to provide accurate information when creating your account and to keep it up to date.
• You may delete your account at any time from within the App (Settings > Account > Delete Account). Deleting your account will remove your profile and associated user-generated content, subject to the retention terms described in our Privacy Policy.
• We reserve the right to suspend or terminate accounts that violate these Terms, applicable law, or our community standards.

5. Auto-Renewing Subscriptions

The following terms apply to all auto-renewing subscriptions purchased through the Apple App Store or Google Play Store:

• Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
• Subscriptions automatically renew for the same duration and price unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period, at the then-current price for the subscription tier you selected.
• You can manage your subscription and turn off auto-renewal at any time by going to your Account Settings on the App Store or Google Play Store after purchase.
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription, where applicable.
• No cancellation of the current subscription is allowed during the active subscription period, but you may cancel to prevent future renewal.
• Refunds are handled solely by Apple or Google in accordance with their respective refund policies. Craftitivity does not process payments directly and cannot issue refunds on their behalf.
• Subscription prices may vary by region and are subject to change; we will notify you of any price changes in accordance with Apple's and Google's respective guidelines before they take effect on your next renewal.

6. User Content and License Grant

"User Content" means any photos, journal entries, saved links, thumbnails, videos, messages, or other material you upload, save, or create within the App.

• You retain ownership of your User Content.
• By submitting User Content, you grant Craftitivity a non-exclusive, worldwide, royalty-free license to store, host, display, and process that content solely for the purpose of operating and providing the Service to you (and to friends you share content with via Chat).
• You are solely responsible for your User Content and represent that you have the necessary rights to save, upload, or share it, including any content sourced from third-party platforms such as Pinterest, Instagram, Facebook, or YouTube.
• Craftitivity does not claim ownership of content originally created by third parties that you save or link to within the App (e.g., saved thumbnails from social media). Such content remains subject to the rights of its original creators and the terms of the platform it was sourced from.

7. Community Conduct and Chat

The Chat feature allows you to message and share inspiration with users you have added as friends. By using Chat, you agree that you will not:

• Harass, threaten, or abuse other users
• Share content that is illegal, infringing, obscene, or violates the rights of others
• Impersonate another person or misrepresent your affiliation with anyone
• Use the feature to distribute spam or unsolicited commercial content

Reporting and Enforcement: You can report or block another user directly within the App. We review reports of abusive conduct or content and may remove content, suspend, or terminate accounts that violate these Terms. We reserve the right, but do not assume the obligation, to monitor Chat and User Content for compliance with these Terms.

8. Third-Party Content and Links

Craftitivity allows you to save links, thumbnails, and previews from third-party platforms (such as Pinterest, Instagram, Facebook, and YouTube). We are not affiliated with, endorsed by, or responsible for the content, accuracy, or availability of any third-party platform or the material you choose to save from it. Your use of those platforms remains subject to their own terms of service.

9. Intellectual Property

The App, including its design, features, graphics, and underlying software, is owned by Craftitivity and protected by intellectual property laws. Except for the limited license to use the App as intended, these Terms do not grant you any rights to Craftitivity's trademarks, logos, or proprietary technology.

10. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms. You may stop using the App and delete your account at any time as described in Section 3. Sections of these Terms that by their nature should survive termination (including Sections 6, 9, 11, 12, and 13) will continue to apply.

11. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY SAVED CONTENT WILL BE PRESERVED WITHOUT LOSS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRAFTITIVITY AND ITS OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50 IF YOU HAVE NOT MADE ANY PAYMENTS.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States of America, without regard to conflict-of-law principles.

14. Apple and Google Terms

If you downloaded the App from the Apple App Store, you acknowledge that these Terms are between you and Craftitivity only, not Apple, and Apple has no obligation to provide support or maintenance for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple is not responsible for addressing any claims relating to the App or your possession/use of it, including product liability claims, legal compliance claims, or claims under consumer protection law. Apple is a third-party beneficiary of these Terms and may enforce them against you.

If you downloaded the App from the Google Play Store, your use is also subject to the Google Play Terms of Service.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by email before the changes take effect. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
